Terms and Conditions of Service

These Terms of Service (“TOS”) govern your use of the online websites, interfaces, features, and services (collectively the “Services”) owned and operated by Belovd Memorial (“Company”, “we”, or “us”). Please read these TOS carefully before accessing or using the services.

1. GENERAL AGREEMENT & ELIGIBILITY

By accessing or using the Services, you agree to these TOS. You attest that you are at least the age of majority in your State or Province of residence and are legally capable of entering into a binding contract. We reserve the right to alter or amend these TOS at any time by updating the effective date on this page.

2. DESCRIPTION OF SERVICES & AGENT ROLE

Our Role: Belovd Memorial acts as a Marketing Agent.

Service 1 (Simple Cremation): Sold by the Company and delivered by a third-party, licensed, and registered Funeral Director in each state.
Service 2 (Memorial): Unattended scattering of cremated remains of deceased persons.
Bundling: These services may be purchased together as a bundle or individually.

3. AUTHORIZED STATES OF OPERATION

We offer services only in the following US States:

Alabama, Alaska, Arizona, Arkansas, Delaware, Florida, Hawaii, Idaho, Indiana, Kansas, Kentucky, Louisiana, Maine, Mississippi, Missouri, Minnesota, Montana, Nebraska, Nevada, New Jersey, New York, North Dakota, Ohio, Oklahoma, Oregon, Rhode Island, South Carolina, South Dakota, Utah, Vermont, Virginia, West Virginia, Wisconsin, and Wyoming.

4. USER CONTENT & COMMUNITY STANDARDS

You are responsible for all data, text, and photographs (“User Content”) you post, such as memorial postings. You may not post content that contains profanity, personal attacks, hate speech, or false claims about how someone died. You grant the Company a royalty-free, perpetual license to use, copy, and display User Content provided through the Services.

5. LIMITATION OF LIABILITY & DISCLAIMER

“As Is”: Services are provided on an “AS IS” and “AS AVAILABLE” basis.

Liability Cap: To the fullest extent permitted by law, our liability is limited to the amount you paid for the specific product or service in question.
Third Parties: The Company is not liable for any damage or loss caused by the acts or omissions of third-party funeral directors or service providers.

6. DISPUTE RESOLUTION: ARBITRATION & CLASS ACTION WAIVER

Good Faith: You must first contact us at hello@belovd.memorial to resolve any disagreement.
Mandatory Arbitration: If unresolved within 60 days, disputes shall be resolved by binding individual arbitration through JAMS.
Class Action Waiver: You and the Company agree that the arbitrator must decide any dispute on an individual basis. No dispute shall be arbitrated on a class or representative basis.

7. GOVERNING LAW & JURISDICTION

These TOS are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Refund and Cancellation Policy

1. CANCELLATION OF CREMATION SERVICES

Pre-transport: If you cancel the "Simple Cremation" service more than 24 hours before the deceased has been collected for transport to the funeral facility, you are entitled to a refund minus a $199.00 administrative fee.

The service is non-refundable from the time of 24 hours before the deceased has been collected for transport.

For clarity, once the remated remains of the deceased has been collected for transport to the Memorial Ashes Scattering location, initiated transportation or care of the deceased, the service is non-refundable.

2. CANCELLATION OF MEMORIAL ASHES SCATTERING SERVICES

Pre-transport: If you cancel the "Memorial Ashes Scattering" service more than 7 Days before the cremated remains of the deceased has been collected for transport to the location of the "Memorial Ashes Scattering", you are entitled to a refund minus a $199.00 administrative fee.

The service is non-refundable from the time of 7 days before the cremated remains of the deceased has been collected for transport to the location of the "Memorial Ashes Scattering".

For clarity, no refunds are provided once the scattering service has been completed or if the remains have already been shipped to the scattering location.

3. PROCESSING

Approved refunds will be issued to the original payment method within 14 business days.
